Medical Malpractice
What is Medical Malpractice?
When, either through negligent action or an omission or oversight, a medical professional or medical organization causes injury to a patient, they have committed medical malpractice. More simply, medical malpractice is negligence by a health care professional.
How do I know if it's Malpractice?
If you've suffered physically, mentally, or financially due to the miscues of a medical professional, you may have a case for Medical Malpractice.
How is this different from a typical lawsuit?
In Indiana, before you can file a lawsuit, all Medical Malpractice cases are reviewed by a three member Medical Review Panel that will give a legally admissable opinion regarding your case. Other than this extra step, a medical malpractice case proceeds similarly to other types of civil lawsuits. Most are resolved in 2-5 years.
How long do I have to file a claim?
The Statute of Limitations in Indiana is generally two years from the date of the act of malpractice, although exceptions exist. If you think you may have suffered medical malpractice, don't wait. Contact an attorney sooner rather than later. These cases are very complex and take time and expense to properly investigate.
